These Terms of Service (the "Terms") govern your access to and use of the EmpGrid platform (the "Service"), operated by DigiGrowth ("we", "us" or "our"). The Service includes the web dashboard at monitor.empgrid.app and the EmpGrid desktop application. By accessing or using the Service, you agree to these Terms.
In short: use EmpGrid for legitimate work management, tell your team that it is in use, and keep your account secure. Your data stays yours, and you can leave at any time.
01Acceptance of terms#
By creating an account, installing the desktop application or otherwise using the Service, you confirm that you have read and agree to these Terms and to our Privacy policy.
If you use the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms. In that case "you" and "your" mean both you and the organisation.
02The Service#
EmpGrid helps organisations manage work time, attendance, leave, projects and team activity. It has two parts:
- The dashboard at monitor.empgrid.app, where admins and employees manage the workspace and view their data
- The desktop app for Windows, which employees use to clock in and out and to start and stop tracked work sessions. The desktop app is available for Windows only. macOS and Linux versions are not available today.
We may change, add or remove features over time. If we remove a feature that paid workspaces depend on, we will give reasonable notice.
03Accounts#
To use EmpGrid you need an account, either one you register or one your organisation creates for you. You agree to:
- Give accurate, current and complete information, and keep it up to date
- Keep your password secure and confidential
- Take responsibility for all activity under your account, including activity by people you add to your workspace
- Tell us immediately about any unauthorised use of your account
We may suspend or close accounts that break these Terms or contain false information.
04Acceptable use#
You may use EmpGrid for
- Time tracking and project and task management
- Monitoring activity during authorised, tracked work sessions
- Attendance and leave management
- Producing reports about your organisation's work
You agree not to
- Use the Service to break any law or regulation
- Monitor anyone without their knowledge, or where your local law requires consent you have not obtained
- Try to get unauthorised access to any part of the Service, its infrastructure or another workspace's data
- Reverse engineer, decompile or disassemble the Service, except where the law expressly allows it
- Interfere with or disrupt the integrity or performance of the Service
- Access the Service with automated scripts, bots or scrapers, other than the official desktop app
- Resell or redistribute the Service without our written permission
05Monitoring and employee data#
The Privacy policy explains exactly what the Service collects. In particular:
- The desktop app collects activity and screenshots only during a tracking session that the employee starts, and the app shows when tracking is on
- Activity is measured from counts of key presses, mouse clicks and mouse movement. The app never records which keys were pressed, typed text, passwords or message contents.
- The app records the name and window title of the app in front. Screenshots show whatever is on screen at the moment they are taken.
As a workspace admin, you are responsible for making sure your use of EmpGrid's monitoring features complies with the employment, privacy and data protection laws that apply to you. That includes telling employees about monitoring and, where required, getting their consent.
06Your data#
- You keep ownership of all data you and your team submit through the Service
- You give us a limited licence to host, process and display that data, only to provide, secure and improve the Service for you
- We do not sell your data or use it for advertising
- Admins can export reports as CSV files or as print-ready reports that can be saved as PDF, at any time
07Our intellectual property#
The Service, including its content, features, design and underlying technology, is and remains the property of DigiGrowth and its licensors.
- The EmpGrid name, logo and related marks belong to us
- You may not use our branding without our prior written consent
08The desktop app#
While you have an EmpGrid account, we grant you a limited, non-exclusive, non-transferable licence to install and use the EmpGrid desktop app on Windows computers, for use with the Service.
- Download the app only from empgrid.app/download or from inside the app itself
- The app checks for updates and installs a new version when you choose to. Older versions may stop working with the Service over time.
- You can turn "start on boot" off in the app. Starting the app does not start tracking.
09Plans and billing#
EmpGrid offers a free plan. Paid plans, where offered, are described on our pricing page. If you choose a paid plan:
- Fees are billed in advance for the billing period you choose
- Fees are non-refundable unless we say otherwise in writing, or the law requires a refund
- We may change prices with at least 30 days' notice, and changes apply from your next billing period
- If you don't pay, we may suspend or close your workspace
- If you downgrade, you may lose features or limits that the lower plan doesn't include
10Termination#
- By you. You can stop using the Service at any time. To close your workspace, email [email protected].
- By us. We may suspend or end your access if you break these Terms, act fraudulently, or don't pay fees you owe.
When your workspace is closed:
- Your right to use the Service ends
- We delete the workspace's data within 30 days, as described in the Privacy policy
- Export any reports you need before you close. Admins can export reports as CSV files or as print-ready reports that can be saved as PDF.
- Any fees you still owe remain payable
11Disclaimers#
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. This includes, without limitation:
- Implied warranties of merchantability, fitness for a particular purpose and non-infringement
- Any warranty that the Service will be uninterrupted, secure or error-free
- Any warranty about the accuracy or reliability of information obtained through the Service
Activity percentages and idle time are estimates based on input counts. Do not use them as the only basis for decisions about an employee.
12Limitation of liability#
To the maximum extent allowed by law, DigiGrowth is not liable for:
- Any indirect, incidental, special, consequential or punitive damages
- Loss of profits, data, use, goodwill or other intangible losses
- Damage resulting from unauthorised access to or changes to your data
- Any interruption or end of the Service
Our total liability for any claim under these Terms is limited to the amount you paid us in the twelve (12) months before the event that gave rise to the claim.
13Governing law#
These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of India have exclusive jurisdiction over any dispute arising from these Terms or the Service.
14Changes to these terms#
We may change these Terms. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Tell users through the EmpGrid dashboard or by email
- Give paid workspaces at least 14 days' notice before the changes take effect
If you keep using the Service after changes take effect, you accept the revised Terms. If you don't agree, stop using the Service and close your workspace.
